If you have been accused of a DUI in Sterling Heights, Macomb County or Oakland County, then The Law Offices of Cy M. Abdo can defend you against charges. Mr. Abdo has over 25 years of experience in practicing criminal and drunk driving defense in Sterling Heights and Warren. He develops strategies crafted to meet goals such as dismissal, reduced charges, and reduced sentencing.

Developing DUI defense strategies

Many people who experience a DUI arrest in Sterling Heights assume that there is no plausible defense. They think that the results of a breathalyzer are irrefutable. This is not always true. Cy M. Abdo explores all angles of your case:

  • Reviewing if the police had reason to stop you in the first place
  • Questioning whether the breathalyzer instrument was working properly
  • Ensuring that the police followed proper procedure when administering the breathalyzer test or a field sobriety test
  • Reviewing the police report for instances of inaccuracies

If you face Sterling Heights DUI allegations for which the police did not follow proper procedure or if doubts have been raised about the truthfulness of the ‘facts,’ Mr. Abdo may be able to achieve a dismissal or reduction of charges during negotiations with prosecutors.

Michigan DUI categories

In Michigan, there are three terms associated with driving under the influence:

  • OWI: operate while intoxicated; this means that your blood alcohol content was not less than .08% or that alcohol or drugs in your body substantially affected your ability to drive a vehicle safely.
  • OWVI: operate while visibly impaired; this is essentially the same charge as an OWI, but an OWVI does not necessarily have a BAC level associated with it.
  • OWPD :operate with the presence of drugs; Michigan states that operators of vehicles cannot have any trace of a schedule 1 controlled substance or cocaine in their bodies, even if they are not intoxicated.

Michigan is considered a “zero tolerance” state, which means that operators of vehicles under the age of 21 with a BAC between .02 and .07 are automatically considered operating while intoxicated.
