Michigan DUI categories
In Michigan, there are three terms associated with driving under the influence:
- OWI: operate while intoxicated; this means that your blood alcohol content was not less than .08% or that alcohol or drugs in your body substantially affected your ability to drive a vehicle safely.
- OWVI: operate while visibly impaired; this is essentially the same charge as an OWI, but an OWVI does not necessarily have a BAC level associated with it.
- OWPD :operate with the presence of drugs; Michigan states that operators of vehicles cannot have any trace of a schedule 1 controlled substance or cocaine in their bodies, even if they are not intoxicated.
Michigan is considered a “zero tolerance” state, which means that operators of vehicles under the age of 21 with a BAC between .02 and .07 are automatically considered operating while intoxicated.
