Eligibility for Michigan Expungement

You may be entitled to an expungement of a criminal case (felony or misdemeanor) if you meet certain requirements.

  • More than 5 years have elapsed since your sentence date or release from prison
  • You only have 1 felony offense and 2 minor offenses (amendment effective as of 6/23/11)

Offenses Which Cannot Be Expunged

  • A felony or attempted felony punishable by life in prison
  • A conviction or attempted conviction of a criminal sexual conduct offense
  • A traffic offense or drunk driving
