First Party Benefits (Commonly Known as Personal Injury Protection Benefits or PIP)

First party benefits (PIP) benefits exist in every No-Fault Michigan automobile insurance policy and provide for specific compensation without regard to fault for a covered injury. The basic components of Personal Injury Protection Benefits are compensation as follows:

  • All necessary medical costs for an injury due to an automobile accident.
  • Up to 3 years of wages you would have earned.
  • Replacement costs up to $20.00 per day for services that you cannot provide for your home and family because of an auto related injury.

PIP compensation can mean lifetime benefits which include a monthly payment to cover extraordinary expenses for serious disabilities.

Third Party Claim Against the Party at Fault

In addition to PIP benefits, a person who suffers a qualifying injury or death in a motor vehicle accident may have a legal claim or lawsuit against the party at fault. A qualifying injury means permanent or serious disfigurement or serious impairment of a body function. Serious impairment of body function" means an objectively manifested impairment of an important body function that affects the person's general ability to lead his or her normal life.

The crux of a third party claim is to seek maximum monetary compensation for non-economic losses such as pain, suffering, mental anguish along with all economic losses not otherwise covered by No-Fault policy.

Death, serious injuries and permanent disability may mean that we are seeking monetary damages in excess of one million ($1,000,000.00) dollars. When confronted with such claims, economic recovery and collection may be limited by the extent of insurance carried by the party at fault. Our job is to seek out all responsible parties (including bars and taverns/Dram Shop) that may be liable for damages. In addition, an individual’s No-Fault policy may contain benefits for underinsured motorists or uninsured motorists.

Insurance Companies Video Tape Conduct of Alleged Injured Parties Engaged in Physical Activities!

It is quite common for the defending insurance company to challenge whether a claimant has suffered a serious impairment of a body function. Once involved, the insurance company will attempt to minimize the extent of injuries claimed. The insurance company may hire an investigator to monitor the physical activities and daily routine of an alleged injured party. The investigator often utilizes video surveillance in an attempt to catch a claimant engaged in strenuous activity (lifting, climbing stairs) and/or recreational pursuits (bowling, jogging).
