There are many ways that law abiding citizens could face an arrest though they have remained compliant with the MMMA. Most obviously is an arrest that occurs when a patient or caregiver does not have their card on them. Another example is an arrest in the period between their application for a card and receiving it. And yet another example is disputed amounts of marijuana, as the statute distinguishes between what is and what is not "usable". Further, there is always the fallback affirmative defense. This allows those without a card to argue that they were using marijuana for medical purposes. This is not meant to be an exhaustive list, but rather a few scenarios that provide strong arguments for us to employ in court.
