Macomb County and the Macomb County Circuit Court

Macomb County occupies 482 square miles with 27 municipalities, 9 district courts, 32 miles of Lake St. Clair shoreline, and a population of 870,987 according to the 2010 census. Three of Michigan’s top 10 most populated cities are located in Macomb County; Warren, Sterling Heights, and Clinton Township. Macomb County is the third largest county in Michigan behind only Wayne County and Oakland County respectively.

Macomb County is considered a Metro Detroit community. The borders of Macomb County consist of Lake St. Clair, Oakland County (Dequindre Road), St. Clair County, and Wayne County (8 Mile Road). Macomb County is accessible via major interstates, namely the I-94 and I-696 expressways. The County’s most prominent industry is automobile related manufacturing, with major manufacturing infusing the area with over $2 billion dollars since 1990. Similar to the neighboring counties of Oakland and Wayne, Macomb County recently underwent a government restructuring and elected its first County Executive, Mark Hackel.

Macomb County is home to Selfridge Air National Guard Base.

Police Agencies in Macomb County and Lake St. Clair

Many cities and townships in Macomb County have their own police departments. Sterling Heights, Warren, Shelby Township, Clinton Township, and Chesterfield Township have large scale police departments with special units. The Macomb County Sheriff’s Department provides police services throughout the county and to communities without a dedicated police force such as Macomb Township, Washington Township, and Mt. Clemens. The Michigan State Police are responsible for the interstate expressways (I-94 and I-696) within Macomb County. The Macomb County Sheriff’s Department has various special units to monitor computer activity (e.g. child pornography) and drug crimes. There are also several agencies that provide law enforcement services for activities on Lake St. Clair including the United States Department of Homeland Security, the United States Coast Guard, the Michigan Department of Natural Resources, and the Macomb County Sheriff’s Department.

The Macomb County Sheriff’s Department and the Macomb County Jail are located at 43565 Elizabeth Rd, Mt Clemens, MI 48043. Professional visits with inmates are permitted by attorneys for seven (7) days a week as follows: 8:00 AM - 11:30 AM; 1:00 PM - 4:00 PM; 5:30 PM - 9:00 PM.

Macomb County Circuit Court  

Michigan’s circuit courts hear the more serious criminal and civil cases. Criminal cases that are classified as felonies (i.e. crimes punishable up to life in prison) will be heard in the circuit court following preliminary examination in the district court. Michigan circuit courts have jurisdiction for:

  • Criminal felony proceedings through trial.
  • Criminal felony probation violations.
  • Civil lawsuits $25,000 or more. 
  • Appeals of cases tried in the district courts.
  • Equitable power to issue injunctions.
  • Juvenile delinquency and divorce.

The Macomb County Circuit Court is located at 40 N. Main Street, Mt. Clemens, Michigan 48043. The Macomb County Circuit Court Judges are: James M. Biernat Jr., Matthew S. Switalski, Mark S. Switalski, Edward A. Servitto Jr., Michael Servitto, Richard L. Caretti, Joseph Toia, Carl J. Marlinga Diane M. Druzinski, Mark S. Switalski, Jennifer M. Faunce, Katherine A. Viviano, Tracy A. Yokich, Rachel Rancilio, and Julie Gatti. The Macomb County Circuit Court has jurisdiction over serious criminal matters that are classified as felonies; felonies carry more than 1 year, up to life in prison. Arraignment on the Information for felonies are scheduled every Monday, or Tuesday when a holiday falls on Monday, at 1:30 p.m. The dockets are posted on the main floor which contain the defendant’s name, case number, judge assigned to the case and criminal defense attorney of record.

Prosecutions for felonies at the Macomb County Circuit Court are pursued either by the Macomb County Prosecutor’s Office or by the Michigan State Attorney General.
