10 Things You Need to Know if You are Being Investigated or Charged

If you are being investigated or have been charged with a crime, making decisions under stress and without a sound legal strategy can lead to devastating consequences. The police, prosecutor, victim’s rights advocate, probation department and the court are all on the side of the government. ABDO LAW is on your side and we want you to KNOW YOUR RIGHTS and avoid making common mistakes. Based upon our vast experience, here are 10 things that will give you an advantage if you are faced with a criminal situation:

  1. Investigations & Interrogation: You are not required to talk to the police pursuant to the 5th Amendment of the United States Constitution. The police use ambush tactics to catch a suspect off-guard to get a statement or confession before an attorney is employed.
  2. Arrest: If you are placed under arrest, ask if you notify your lawyer or family member, do not resist, do not argue the case with the arresting officer and do not make any incriminating statements. Following an arrest, you will be booked and held for an arraignment or released after a bond is provided. If you are arrested for a DUI misdemeanor, you will be released after impairment is no longer a factor and bond is posted.
  3. Warrants: If you suspect that you have an outstanding warrant for your arrest, or if you receive notifying of a pending warrant, contact our Macomb County Criminal defense lawyers to have the warrant resolved before it’s too late you are arrested.
  4. Arraignment & Bond: The best possible bond is called a “personal recognizance bond” which does not require any money component unless the defendant fails to appear in court. Other bonds may be required in the form of cash, surety (bondsman) or a 10% cash component. Your chance of getting a personal bond or low bond greatly improved with an attorney that knows the local court system and how to represent you at an arraignment.
  5. Domestic Violence & No-Contact Orders: Invariably, the court will impose a no-contact order if you are charged with a with assault, domestic violence, or a sex crime. Violating a no-contact order can result in revocation of bond, incarceration and additional bond conditions such as Global Positioning Systems (GPS) monitoring.
  6. Drug Crimes & Cooperation: If you are charged with a drug crime, do not immediately agree to cooperate with the police (act as an informant) without consulting with a drug crimes lawyer at ABDO LAW. Most drug crimes can be resolved favorably without acting as an informant and doing potentially dangerous undercover drug deals or snitching.
  7. Sex Crimes & Polygraphs: A polygraph measures pulse, respiration, blood pressure and skin conductivity while a person is asked sensitive questions. Polygraphs are commonly used in connection with sex crime interrogations. You should never agree to take a polygraph without first consulting with an attorney.
  8. Drunk Driving: Contact an attorney if you have been charged with any DUI (1st, 2nd, 3rd or High BAC .17) to find out what proactive measures can be taken before your case ever goes to court. Our Macomb County DUI/OWI attorneys can explain all of the local policies (Shelby, Utica, Macomb, Clinton, Sterling, New Baltimore, Chesterfield, Washington, Romeo), what you can expect if you refused a chemical test and how we can fight your case in the court system.
  9. Gun Rights: A person convicted of a felony is permanently banned from owning or possessing a firearm. A misdemeanor conviction will result in loss of CPL privileges for 3 or 8 years (depending upon the offense).
  10. Criminal Record: A record is created the moment that you are charged with a crime. A record can survive even when a criminal case is dismissed or after a not guilty verdict. Our Macomb County criminal defense lawyers can explain how we can control issues regarding records, when records can be sealed from public view and cases handled without entry of a conviction for adults or juveniles.
