A misdemeanor is defined as a criminal offense punishable by 1 year or less in jail and a felony is defined as a more serious criminal offense punishable by more than 1 year, up to life in prison. Although breath tests are administered exclusively to test for alcohol; blood tests are administered when drug use is suspected or by court order when an accused party refuses to provide a breath, blood, or urine sample.
