Michigan Domestic Violence Penalties:
| 1st Offense Misdemeanor: | Maximum penalty 93 days in jail, fine up to $500.00 |
| 2nd Offense Misdemeanor: | Maximum penalty 1 year in jail, fine up to $100.00 |
| 3rd Offense Felony: | Maximum penalty 2 years in prison, fine up to $2,000.00 |
A person arrested pursuant to the Michigan Domestic Laws cannot be released from jail until bond is set by a judge or magistrate. Bond usually requires that some cash be posted and that the person charged have no contact with the victim. For example, if you are told that you cannot have contact with the victim, you may not be able to return to your home if you reside with the victim such as your spouse or significant other.
It only takes one of the parties to call 911 and say that there was some forceful physical contact for the police to get involved. Once the police get involved, the police will take separate statements from the parties and dig for details substantiating the 911 call. In many cases, alcohol is a factor contributing to the event.
